The benefits will be covered by either the insurance company of the car you were riding in or, if you were a pedestrian or cyclist, of the vehicle that hit you.

 

In Ontario, if no insured driver is involved in a motor vehicle accident, injured persons have recourse through the Motor Vehicle Accident Claims Fund to receive Statutory Accident Benefits, which are also known as no-fault benefits.

 

Accessing Your Benefits


Whether you have insurance or not, the process to access accident benefits is similar:

  1. Report the accident to the police and seek medical attention immediately.

  2. Notify the appropriate insurance company (yours or the at-fault driver's) within 7 days of the accident.

  3. Complete and apply for Accident Benefits (OCF-1 form) within 30 days of receiving it.

  4. Have your healthcare provider complete a treatment plan (OCF-18 form) for any proposed treatments.

  5. Keep detailed records of all accident-related expenses and medical treatments.
